US Enacts Global Visa Restrictions on Cybercriminals and Their Families

The United States government announced a new global visa restriction policy on July 23, 2026, enabling denial of visas to foreign nationals involved in cybercrime and cyber-enabled offenses. The policy, implemented under Section 212(a)(3)(C) of the Immigration and Nationality Act, extends to immediate family members of such individuals.

Cybercrime Losses and Targeted Activities

U.S. citizens lost at least $10 billion to online investment scams in 2024, with schemes known as “pig butchering” identified as a major threat. The policy targets cyber-enabled crimes including investment fraud, cyberscams, and sextortion. Multiple online fraud operations are linked to Chinese transnational criminal organizations involved in corruption, money laundering, and

human trafficking.

Official Statements and Policy Context

U.S. Secretary of State Marco Rubio announced the measures, stating, “By restricting visa issuance to those who are responsible for or complicit in these criminal enterprises, we are sending a clear message: The United States will go after those who prey on our citizens.” The visa restrictions follow President Donald Trump’s Executive Order 14390, which directed federal agencies to intensify efforts against global cybercrime and fraud networks.

Implications for Visa Applicants and Families

The policy authorizes refusal of U.S. visas to foreign nationals responsible for or complicit in cyber-enabled criminal activities. Immediate family members of such individuals may also be barred from entering the

country. This expands the use of visa restrictions beyond immigration violations to include deterrence against cybercriminal networks targeting Americans.

International Cooperation and Visa System Tightening

The new visa restrictions are part of a broader initiative to combat transnational cybercrime, involving cooperation with countries including those in Africa that work with the U.S. to combat online fraud and digital scams. The policy aligns with global trends of tightening visa systems to address evolving security threats related to cyber-enabled crime.
